1. Services
Precision Command Partners LLC provides AI business consulting and technology services including but not limited to: AI-powered phone receptionist systems, automated SMS notification systems, appointment booking automation, social media automation, lead generation systems, custom business website development, and customer relationship management setup and management.
Services are provided to business clients on a monthly retainer basis pursuant to a separate Service Agreement executed between PCP and each client.
2. Eligibility
You must be at least 18 years of age and have the legal authority to enter into binding agreements on behalf of yourself or your business to use our services. By using our services, you represent and warrant that you meet these requirements.
3. Acceptable Use
You agree to use our website and services only for lawful purposes and in accordance with these Terms. You agree not to:
- Use our services to send unsolicited commercial messages (spam) or violate any anti-spam laws including the CAN-SPAM Act and the Telephone Consumer Protection Act (TCPA).
- Use our AI phone or SMS systems to harass, threaten, or deceive any person.
- Attempt to gain unauthorized access to our systems or any third-party systems.
- Use our services to violate any applicable local, state, federal, or international law or regulation.
- Misrepresent your identity or affiliation with any person or organization.
- Interfere with or disrupt the integrity or performance of our services.
4. SMS Services and TCPA Compliance
PCP operates SMS notification systems on behalf of business clients. All SMS campaigns operated through PCP systems are subject to the following terms:
- All SMS messages are operational notifications sent to individuals who have provided express consent to receive such communications.
- Recipients may opt out at any time by replying STOP to any message.
- Business clients are responsible for ensuring that all staff members designated to receive SMS notifications have provided appropriate consent.
- PCP complies with all applicable requirements under the Telephone Consumer Protection Act (TCPA) and carrier A2P 10DLC registration requirements.
- Standard message and data rates may apply to recipients based on their mobile carrier plans.
5. Client Responsibilities
Business clients who engage PCP for services agree to:
- Provide accurate and complete business information required for service setup.
- Ensure that all staff phone numbers provided for SMS notifications belong to individuals who have consented to receive such messages.
- Comply with all applicable laws in connection with the use of PCP services.
- Not use PCP services for any unlawful or prohibited purpose.
- Promptly notify PCP of any unauthorized use of their account or services.
6. Intellectual Property
All content on the precisioncommandpartners.com website, including text, graphics, logos, and software, is the property of Precision Command Partners LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
Custom websites and technology systems built by PCP for clients are owned by the respective clients upon full payment of all applicable fees, unless otherwise specified in the Service Agreement.
7. Payment Terms
Services are provided on a monthly retainer basis. Payment terms, setup fees, and retainer amounts are specified in the individual Service Agreement executed with each client. Failure to make timely payments may result in suspension or termination of services. All fees are non-refundable unless otherwise specified in the Service Agreement.
8. Disclaimer of Warranties
Our website and services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our services will be uninterrupted, error-free, or completely secure.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Precision Command Partners LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising from these Terms or our services shall not exceed the amount you paid to us in the three months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless Precision Command Partners LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from your use of our services, your violation of these Terms, or your violation of any rights of a third party.
11. Termination
We reserve the right to suspend or terminate your access to our services at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use our services immediately ceases. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these Terms or our services shall be resolved through binding arbitration in Polk County, Florida, in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the effective date at the top of this page. Your continued use of our website or services after any changes constitutes your acceptance of the updated Terms.
